Marlett joined Brown & Partners LLP  as an associate in June of 2003. She was admitted to the Bar in 1997 and has been practising in the area of insurance since 1997.

Marlett’s current practice focuses on acting on behalf of insurers in the defence of statutory accident benefits claims, including acting on behalf of auto insurers in loss transfer and priority disputes between insurers.

Marlett has appeared in the Ontario Superior Court of Justice and before the Financial Services Commission of Ontario at all levels of the dispute resolution process.

Marlett is a member of the Law Society of Upper Canada and the Advocates’ Society.

Current Decisions

Brako and State Farm Mutual, July 30, 2003.  The applicant failed to make herself reasonably available for an insurer examination.  As a result, the arbitration was stayed until she made herself available for the examination.  Pursuant to s. 42(8), she was not entitled to benefits for the period after she received notice of the benefit and before she submits to the assessment.

N. H. and General Accident, September 24, 2004.  The applicant was found to have capacity to proceed with the arbitration hearing.  The arbitration was dismissed for failure to bring evidence res judicata and limitation period argued.

Pilot Insurance and Farro, decision by FSCO dated March 19, 2007.  The insured was claiming income replacement benefits. The arbitrator held that Pilot was not liable to pay the applicant any benefits or interest.  The applicant was ordered to pay Pilot’s expenses incurred in respect of the arbitration.

State Farm and Satputhiran.  Decision by FSCO pending.
