Defence counsel will be familiar with the situation where an insured cannot be contacted or, worse yet, flat-out refuses to discuss their case, attend discovery, or otherwise assist in the defence of their case. In this situation, the insurance company client will often need to be added to the proceeding as a statutory third party pursuant to section 258(14) of the Insurance Act, R.S.O. 1990, c. I.8.
